‘Jang Won-young defamation’ Taldeok Rehabilitation Center, sentenced to 4 years in the second trial as well… “Give me one last chance”

The prosecution has maintained a prison sentence in the second trial for the YouTube channel ‘Talduk Detention Center’ operator, accused of producing malicious videos slandering celebrities such as Jang Wonyoung of the girl group IVE, and earning hundreds of millions in profit.

The Incheon District Court Criminal Appeals Division 1-3 (Chief Judge: Jang Minseok) held an appeals trial on the 16th for the former YouTuber Mr. A (37), who was indicted on charges including violations of the Act on Promotion of Information and Communications Network Utilization and Information Protection (defamation). The prosecution again sought a sentence of four years, as in the first trial.

The prosecution emphasized, “The defendant operated a paid program, earning crime proceeds of approximately 250 million won, and has not been forgiven by the numerous victims,” and noted, “The social impact and maliciousness of the crime are very severe.” Previously, the first trial court sentenced Mr. A to two years in prison, suspended for three years, with 120 hours of community service, and a fine of 200 million won, prompting both the prosecution and the defendant to appeal on grounds of unfair sentencing.

The defense attorney for Mr. A appealed for leniency, stating, “The defendant deeply regrets the harm caused by his actions while being socially criticized,” adding, “He attempted to make reparations when victims rejected settlement and voluntarily closed his YouTube channel.” Furthermore, they argued that “The initial sentence is not light at all,” maintaining that the suspended sentence is appropriate.

In his final statement, Mr. A commented, “I compiled posts and comments from the internet to create videos. At the time, I believed I was fulfilling the public’s right to know, but I now realize how wrong that was.” He added, “Living under stigma after my identity was exposed, I am receiving psychiatric treatment and reflecting on my actions every day. Please give me a last chance to live again as a proper member of society,” he pleaded emotionally.

From October 2021 to June 2023, Mr. A is accused of posting 23 false videos defaming seven celebrities and influencers, including Jang Wonyoung, through his ‘Talduk Detention Center’ channel. He spread false claims such as “Jang Wonyoung’s jealousy canceled her fellow trainee’s debut” and “Famous celebrities underwent plastic surgery or engaged in prostitution.” He also posted 19 videos mocking or insulting the appearances of five victims.

Mr. A introduced various levels of paid memberships, earning about 250 million won over two years, and is investigated to have purchased real estate with this money. The prosecution stressed that this profit is clear criminal proceeds, insisting on maintaining the forfeiture order.

‘Talduk Detention Center’ once claimed to cover entertainment issues, boasting hundreds of thousands of subscribers, but has been controversial for its malicious false videos and provocative titles. The court in the first trial pointed out, “These actions repeatedly violated the honor of specific individuals, exceeding the scope of press freedom.”

Mr. A’s appellate sentencing trial is scheduled for the 11th of next month. Fans and the public express, “Strict punishment for producing false information is necessary.”
